LOCATION AND CHANGES TO TERMS OF USE

This Terms of Use may be updated or modified from time to time. We will provide notice of any changes by posting the new Terms of Use on our website located at https://vrquest.hamiltonbuhl.com/terms-of-use or other publicly accessible portions of VR Quest®.  Your use of the VR Quest® Services after such update or modification constitutes your acceptance of such changes to this Terms of Use.

Any such updates or modifications shall be effective when posted and you are advised to consult this and the Privacy Policy regularly for any changes. 

USER GENERATED CONTENT

VR Quest® may allow you to communicate, submit, upload or otherwise make available text, images, audio, video, competition entries or other content (“User-Generated Content”), which may be accessible and viewable by the public. Access to these features may be subject to age restrictions. You may not submit or upload User Generated Content that is defamatory, harassing, threatening, bigoted, hateful, violent, vulgar, obscene, pornographic, or otherwise offensive or that harms or can reasonably be expected to harm any person or entity, whether or not such material is protected by law.

License to Use Your Content. When you post Content to VR Quest®, you authorize VR Quest® to make copies to facilitate the posting and storage of such Content on the Service. We do not claim ownership to your User Generated Content; However, by posting Content to any part of the Service, you automatically grant a non-exclusive, transferable, fully-paid royalty-free, worldwide license (with the right to sublicense) to use, copy, modify, publicly perform, publicly display, reformat, translate, excerpt and distribute such Content for any purpose. You also grant each user of the Application a non-exclusive license to access your Content through the Service, and to use, reproduce, distribute, display and perform such Content as permitted through the functionality of the Service and under these Terms.

You represent and warrant that your User Generated Content conforms to these terms and that you own or have the necessary rights and permissions, without the need for payment to any other person or entity, to use and exploit, and to authorize us to use and exploit, your User Generated Content in all manners contemplated by these terms. You agree to indemnify and hold us and our subsidiary and affiliated companies, and each of their respective employees and officers, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against us by any third party arising out of or in connection with our use and exploitation of your User Generated Content. You also agree not to enforce any moral rights, ancillary rights or similar rights in or to the User Generated Content against us or our licensees, distributors, agents, representatives, and other authorized users, and agree to procure the same agreement not to enforce from others who may possess such rights.

To the extent that we authorize you to create, post, upload, distribute, publicly display or publicly perform User Generated Content that requires the use of our copyrighted works, we grant you a non-exclusive license to create a derivative work using our copyrighted works as required for the purpose of creating the materials, provided that such license shall be conditioned upon your assignment to us of all rights in the work you create. If such rights are not assigned to us, your license to create derivative works using our copyrighted works shall be null and void. We have the right but not the obligation to monitor, screen, post, remove, modify, store and review User Generated Content or communications sent through VR Quest®, at any time and for any reason, including to ensure that the User Generated Content or communication conforms to these terms, without prior notice to you. We are not responsible for and do not endorse or guarantee, the opinions, views, advice or recommendations posted or sent by users.

LICENSE KEYS AND ACCOUNTS

VR Quest® permits or requires you to purchase a license key to use the software, and to participate or to secure additional benefits. You agree to provide and maintain accurate, current and complete information, including your contact information for notices and other communications from us. You agree not to impersonate or misrepresent your affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name or likeness, or provide false details for a parent or guardian. You agree that we may take steps to verify the accuracy of the information you provide, including contact information for a parent or guardian. We may suspend or terminate your account and your ability to use the VR Quest® if you engage in, encourage or advocate for illegal conduct, or if you fail to comply with these terms or any supplemental terms.

SITE LICENSE KEYS AND SECURITY

Site License Keys are limited for use at the location(s) for which the license was purchased.  Copies of the software are not allowed for individual use outside of the intended location(s).  You are responsible for taking reasonable steps to maintain the allowed use of your license key, and you are responsible for all activities under your account that you can reasonably control.   You agree to promptly notify us of any unauthorized use of your license key or other account information, or of any other breach of security that you become aware of involving your account or VR Quest®.

The security, integrity, and confidentiality of your information are extremely important to us. We have implemented technical, administrative and physical security measures that are designed to protect your information from unauthorized access, disclosure, use, and modification.

VR Quest® and affiliated companies offer to its users’ access to applications, some of which are primarily targeted at children, and others that are intended for users of all ages, schools and families. Our sites and applications offer a variety of activities, including activities that may collect information from children. Below we summarize potential instances of collection and outline how and when we will provide parental notice and/or seek parental consent. In any instance that we collect personal information from a child, we will retain that information only so long as reasonably necessary to fulfill the activity request or allow the child to continue to participate in the activity, and ensure the security of our users and our services, or as required by law. In the event we discover we have collected information from a child in a manner inconsistent with COPPA’s requirements, we will either delete the information or immediately seek the parent’s consent for that collection.

CONTENT GENERATED BY A CHILD

Most activities on our sites and applications allow children to create or manipulate content and save it with VR Quest®. Some of these activities do not require children to provide any personal information and therefore may not result in notice to the parent or require parental consent. If an activity potentially allows a child to insert personal information in their created content, we will either pre-screen the submission to delete any personal information, or we will seek verifiable parental consent by email for the collection. Examples of created content that may include personal information are stories or other open-text fields, and drawings that allow text or free-hand entry of information.

ABOUT VERIFIABLE PARENTAL CONSENT

Email Consent. In the event VR Quest® wishes to collect personal information from a child, COPPA requires that we first seek a parent or guardian’s consent by email. In the email, we will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent contact information and any other information collected from the child in connection with that activity. High-Level Consent. In the event VR Quest® collects personal information from a child that will be posted publicly, we will seek a higher level of consent than email consent. Such “high-level” methods of consent include but are not limited to asking for a credit card or other payment method for verification (with a nominal charge involved), speaking to a trained customer service representative by telephone or video chat, or requiring a signed consent form by mail, email attachment, or fax. After providing high-level consent, a parent may have the opportunity to use a pin or password in future communications as a way to confirm the parent’s identity. Teacher consent in lieu of a parent. With regard to school-based activities, COPPA allows teachers and school administrators to act in the stead of parents to provide consent for the collection of personal information from children. Schools should always notify parents about these activities. VIRTUAL REALITY AND HEAD-MOUNTED DISPLAYS

You are responsible for keeping a safe environment for the use of VR Quest®. There should not be any close danger that might risk the safety of the players while interacting with VR Quest® while wearing the head-mounted display.
